2nd VICTORY: U.S. Supreme Court Blocks Trump and Upholds DACA
LGBTQ Dreamers Safe for Now; But Congress Must Pass the Dream Act
 
In a stunning second victory this week, the U.S. Supreme Court blocked Trump’s proposed cancellation of the Deferred Action for Childhood Arrivals (DACA) program in DHS v. Regents of the University of California.  NQAPIA led the LGBTQ community in urging the Court to uphold DACA through an amicus (“friend of the court”) brief that highlighted the special concerns of LGBTQ Asian, South Asian, and Pacific Islander (API) DACA recipients. 
 
But the Court opinion was rooted in legal procedures and expressed no opinion regarding the validity of DACA.  The Court held that Trump needed to provide additional arguments justifying the cancellation of DACA and remanded the case to the lower court. 
 
For now, DACA recipients are safe and cannot be deported. But the job is not done.  DACA can still be cancelled later. 
 
 
NQAPIA led the LGBTQ community in submitting a brief to the Court that showed how more is at stake for LGBTQ DACA recipients.  DACA has helped thousands of LGBTQ API young people trying to work, study, and improve their lives in the United States. For example see stories of  Tony Choi and Bupendra Ram.
